Medical malpractice incident outside New Mexico recently settled

The family of a 38-year-old man was recently awarded $1.7 million in damages for the wrongful death of their loved one. The medical malpractice claim was recently settled in a court outside of New Mexico. The man's family is slated to receive $1.4 million, with annuities of $300,000 paid to his three children over a four-year time span.

The claim alleged that the man died because of a failure to properly diagnose his condition. In 2009, he had been medically treated for severe rectal pain. In the days that followed, he reportedly called the hospital multiple times, complaining of rectal bleeding and continued pain.

Records state that the only medical advice the man was given was to continue to take his pain medication. Not long afterward, he died of bleeding inside the brain. The malpractice claim states that the bleeding was caused by an undiagnosed condition that is known to cause internal bleeding. Ohio State's Stoneridge Medical Center agreed to the settlement recently approved by a judge, but has admitted no wrong-doing in the wrongful death claim.

Medical malpractice is an ongoing problem in New Mexico and throughout the United States. A medical patient has the right to reasonably assume that a high standard of professionalism and safety will be implemented when he or she is under the care of medical professionals. A failure to diagnose an adverse condition can result in a tragedy similar to that in the above-mentioned case. Anyone who believes that he or she has suffered because of substandard medical care may want to consider seeking restitution in court.
