A birth injury affects the mother or her baby during labor, childbirth or the recovery period. While some birth injuries are minor, such as small scratches and bruises, others, such as brain and spinal cord injury, can be permanent or take life.

Common types of malpractice that contribute to birth injuries include failing to diagnose harmful conditions for the mother or baby, failing to order a necessary cesarean section timely or incorrectly using assistive delivery devices such as forceps or a vacuum.
